TERMS OF SERVICE

These Terms of Service apply to the website and online store operated by Valtech Australia Pty Ltd (ABN 41 159 867 759), referred to in these terms as “Valtech Australia”, “we”, “us” or “our”.

By accessing our website or placing an order, you agree to these terms and our Privacy Policy, Return and Refund Policy and Shipping Policy.

  1. PRODUCTS AND TECHNICAL INFORMATION

Valtech Australia supplies 316L stainless steel press-system products, pipe, fittings, valves and associated products.

We take reasonable care to ensure product descriptions, photographs, dimensions, prices and technical information are accurate. Minor differences in appearance may occur because of photography, manufacturing variations or screen settings.

Customers are responsible for confirming that products are appropriate for their intended application, size, installation and applicable plumbing requirements before ordering or installing them.

Products must be installed by appropriately qualified persons and in accordance with applicable laws, standards, manufacturer instructions and WaterMark requirements.

  1. ORDERS

Submitting an order is an offer to purchase products from Valtech Australia. An order is accepted when we confirm acceptance and receive cleared payment.

We may decline or cancel an order if:

  • a product is unavailable;

  • pricing or product information contains an error;

  • payment cannot be processed;

  • the delivery address is outside an area we service;

  • freight arrangements cannot reasonably be completed; or

  • we reasonably suspect fraud, misuse or unlawful activity.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products.

Please review product codes, descriptions, quantities and sizes carefully before submitting an order.

  1. PRICES AND PAYMENT

All prices are displayed in Australian dollars and include GST unless clearly stated otherwise.

Payment must be made in full before dispatch by an available payment method shown at checkout. Orders paid by direct bank transfer will not be dispatched until cleared funds are received.

Prices, availability and promotions may change without notice. Changes will not affect an order that we have already accepted, except where an obvious pricing or system error has occurred.

  1. PRODUCT AVAILABILITY

Product availability and stock information may change without notice. A product appearing on the website does not guarantee immediate availability.

If an ordered product is unavailable, we may contact you to offer a replacement, place the product on backorder or provide a refund for the unavailable item.

  1. DELIVERY AND FREIGHT

We currently deliver within Australia to serviceable addresses.

Standard and express delivery charges displayed at checkout apply only to eligible products and destinations. Delivery timeframes are estimates and may be affected by carrier delays, availability, weather, remote-area access or other circumstances outside our reasonable control.

Eligible standard orders over $1,000 qualify for free standard freight, subject to the exclusions stated on our website and in our Shipping Policy.

Full-length pipe, oversized products, remote-area deliveries and other freight requiring special handling may be excluded from flat-rate or free freight. We may contact the customer to confirm or quote the applicable freight charge before dispatch.

The customer must provide a complete and accurate delivery address and a working contact telephone number. Additional carrier costs caused by an incorrect address, failed delivery or unavailable recipient may be charged to the customer where permitted by law.

Risk of loss or damage remains with Valtech Australia until the products are delivered to the nominated delivery address, subject to applicable law.

  1. INSPECTION OF DELIVERIES

Customers should inspect their order promptly after delivery.

If products appear damaged, faulty, incomplete or incorrectly supplied, contact us as soon as possible at craig@valtechaustralia.co with the order number, details of the issue and photographs where appropriate.

  1. RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds and cancellations are governed by our Return and Refund Policy and the Australian Consumer Law.

Change-of-mind returns are not automatically accepted. Cut-to-length pipe, custom products, specially ordered products and specifically imported products cannot ordinarily be cancelled or returned unless faulty or otherwise required by law.

Do not return products without first obtaining approval from Valtech Australia.

  1. AUSTRALIAN CONSUMER LAW

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where goods have a major problem, eligible consumers may be entitled to choose a refund or replacement. Where a problem is minor, Valtech Australia may choose to repair the product, replace it or provide another remedy permitted by law.

Consumer guarantees may also apply to qualifying purchases made by businesses. Different rights may apply to products acquired for resale or transformation into other goods.

  1. WEBSITE USE

You must not use this website:

  • for an unlawful or fraudulent purpose;

  • to interfere with the website’s operation or security;

  • to introduce viruses, malicious code or harmful material;

  • to collect information about other users without authority;

  • to impersonate another person or business; or

  • to copy or commercially exploit website content without permission.

We may suspend or restrict access where we reasonably believe these terms have been breached.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the website’s design, text, graphics, branding, catalogue material and other original content are owned by or licensed to Valtech Australia.

Product names, photographs and manufacturer information may remain the property of their respective owners.

Website material must not be reproduced, republished, distributed or commercially used without prior written permission, except where permitted by law.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to services provided by Shopify, payment providers, freight providers and other third parties.

Third-party services are governed by their own terms and privacy policies. Valtech Australia is not responsible for the content or availability of an unrelated third-party website.

Purchases made through this store are transactions between the customer and Valtech Australia, not Shopify.

  1. ERRORS AND WEBSITE AVAILABILITY

We may correct typographical errors, pricing errors, inaccurate descriptions or omissions and update website information without notice.

We do not guarantee that the website will always be uninterrupted, secure or error-free. We may temporarily suspend access for maintenance, security or operational reasons.

  1. LIABILITY

To the extent permitted by law, Valtech Australia is not liable for indirect or consequential loss arising from use of the website or products.

Nothing in these terms limits liability or customer rights where doing so would be unlawful, including rights and remedies available under the Australian Consumer Law.

Customers remain responsible for ensuring products are selected and installed correctly by appropriately qualified persons.

  1. PRIVACY

Personal information is handled in accordance with our Privacy Policy. Information may be processed by Shopify, payment providers, delivery providers and other service providers where necessary to operate the store, process payments and fulfil orders.

  1. CHANGES TO THESE TERMS

We may update these Terms of Service by publishing a revised version on our website. The terms applying to an order are generally those in effect when the order is placed.

  1. GOVERNING LAW

These terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and any courts entitled to hear appeals from those courts.
